These Terms of Service ("Terms") govern your access to and use of the Homia iOS application ("App") operated by Homia ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. By using the App, you represent that you meet this requirement.

2. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] of any unauthorized use.

3. User Content

Your Photos and Uploads

You retain ownership of any photos and content you upload to the App ("User Content"). By uploading User Content, you grant Homia a non-exclusive, worldwide, royalty-free license to process, store, and display that content solely to provide the App's services to you.

Prohibited Content

You must not upload content that:

Violates any applicable law or regulation.
Infringes any third-party intellectual property rights.
Contains nudity, violence, or other objectionable material.
Depicts private information of others without consent.
Is intended to deceive or mislead.

4. AI-Generated Outputs

The App uses artificial intelligence to generate redesigned images of your spaces ("AI Outputs"). AI Outputs are provided for visualization and inspiration purposes only. They do not constitute professional architectural, interior design, structural, or contractor advice. We make no warranties that AI Outputs accurately represent how any physical renovation would appear in reality.

You own the AI Outputs generated from your User Content. However, we reserve the right to use aggregated, anonymized design data to improve our models, unless you opt out as described in our Privacy Policy.

5. Shopping Integrations

The App integrates with Dupe.com and may display product recommendations based on your AI Outputs. Product purchases are completed through third-party retailers; Homia is not a party to those transactions. We are not responsible for the quality, accuracy, availability, or delivery of third-party products. Any disputes related to purchases must be resolved with the respective retailer.

6. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or disassemble the App.
Use the App to generate content for commercial resale without our written consent.
Attempt to gain unauthorized access to our systems or other users' accounts.
Use automated scripts, bots, or scrapers to access the App.
Use the App in any manner that could damage, disable, or impair our services.
Circumvent any security features or usage limits.

7. Intellectual Property

The App, including its design, code, branding, and content (excluding User Content and AI Outputs generated from your content), is owned by Homia and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

8. In-App Purchases and Subscriptions

The App may offer free and paid features. Any purchases are processed through Apple and are subject to Apple's payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Refunds are handled per Apple's refund policy.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Homia and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email. Continued use of the App after such changes constitutes acceptance.
